General Smart Supermarket Terms and Conditions:
Smart
Supermarket Loyalty Scheme and Discount Offer Items:
- Loyalty Scheme Offers only valid to smart loyalty scheme members. Non-members may apply for the Smart Loyalty Scheme for FREE
by visiting customer care prior to commencing their shopping.
- Loyalty
Points may only be redeemed upon presentation of the Account Holder's Identity Card.
- Loyalty
Scheme customers can take up to a maximum of 4 of the
same items on offer, in one shopping spree, with a minimum spend of €35 on
non-offer items. The maximum purchase limit (In 1 shopping spree)
for items on offer can differ from time to time at the discretion of Smart
Supermarket. Proper signage will be put in place in a visible manner where this
is the case, to communicate the revised maximum purchase limit (in 1
shopping spree) for the specific product/s.
- For
Special limited time offers on specific product/s, the minimum spend can be increased to
€50. Proper signage will be in place to communicate this.
- For
non-Loyalty Scheme members: Prices of products advertised as monthly special offers will not be
discounted. Normal recommended retail price applies.
- Terms
& Conditions together with purchase limits apply to discounted products advertised
on the Smart Supermarket Magazine and on the shelf signage.
- The
monthly gift schemes/discounts are only available to Loyalty Scheme Members
when the required number of points are redeemed. For more information visit our

- The
supermarket reserves the right to cancel promotions at its own discretion.
- Offers
start on the 1st of each month and end on the last day of the same month.
- Offers
valid until stocks last.
- Free water can only be taken when redeeming a
specific number of Smart loyalty points. Points to redeem for water will vary
depending on the brand.
- Under no circumstances are children allowed to stand
in/on the shopping cart. Shopping carts
are fitted with a child seat facing the shopper just behind the handle where
they can sit in a safe and hygienic manner.
- Pets are only permitted inside the supermarket if they
can be carried in hand
- Under no circumstances are pets allowed to stay in/on
the shopping cart.
- Returns on fresh, frozen and/or perishable items are
not accepted.
- Customers are required to present their ID card and
proof of purchase when returning non-perishable items due to defects in the
product.
- Returns are only accepted if the non-perishable item
has not been used.
- It is not permitted to consume products in the
supermarket unless already purchased.
- Cameras are present throughout the supermarket for
security reasons.
- For online purchases, A €5 online service charge is automatically applied to

- The ‘€5 off with every 500 Smart loyalty points
redeemed’ campaign applies to Smart loyalty scheme members. Kindly visit
customer care to apply for the loyalty scheme for free before you start your
shopping spree.
- In order to benefit from the ‘€5 off with every 500 Smart
loyalty points redeemed’ campaign, the account holder’s ID card must be
presented as with all other point redemption schemes.
- Smart Supermarket reserves the right to stop / terminate the ‘€5
off with every 500 Smart loyalty points redeemed’ campaign at any given time
without prior notice.
- The ‘€5 off with every 500 Smart loyalty points
redeemed’ campaign cannot be exchanged for cash.
- Customers need to inform the cashier at the point of checkout
that they wish to make use of the ‘€5 off with every 400 Smart loyalty points
redeemed’ campaign.
Giveaway Competition – Terms and Conditions
These Terms and Conditions apply to all Giveaways
organised and run by Smart Supermarket, a limited liability company with its
registered number C7910 and registered place of business at Naxxar Road,
Birkirkara.
Participation in the Giveaway is subject to the
following Terms and Conditions. Each Entrant is deemed to have read, understood
and accepted these Terms and Conditions in full.
The Giveaway is hosted solely by the Promoter and
is not affiliated with any social media platform in any way and is not
sponsored, supported or organized by any other company.
1.
Promoter
1.1
The Promoter of this giveaway competition (the “Black Friday
Giveaway”) is Smart Supermarket Malta.
2.1
The Giveaway shall be held online. Entry is free of
charge.
2.2
Participation is only possible within the participation
period, starting from Entry Date until Closing Date. Applications received by
the Entrant after the Closing Date will not be considered by the Promoter.
2.3
All entrants must be residents of Malta and must be of
eighteen (18) years of age or older at the time of entry of the Giveaway.
2.4
Employees of Smart Supermarket and their immediate families
are not eligible to be Entrants. For the avoidance of doubt, “immediate
families” shall mean the entrant’s spouse or partner, children (including
adopted or step-children), parents, siblings, grandparents, and any other
persons who are legally dependent on the individual or who permanently reside
in the same household.
2.5
Entries that do not comply with these Terms and Conditions,
and/or are incomplete, incomprehensible, and/or otherwise invalid will be
disqualified and this determination shall be at the sole discretion of the
Promoter. For the avoidance of doubt, an incomplete or incomprehensible entry
means any entry that is missing required information, is unreadable, corrupted,
improperly submitted, or cannot be reasonably understood or verified by the
Promoter. Such entries will be considered invalid and will not be eligible to
participate in the Giveaway. The Entrant is responsible for the accuracy of the
required information. The Promoter shall not accept any liability for
incomplete or inaccurate information. In addition, the Promoter reserves the
right to exclude Entrants already admitted at any time, including
retroactively, and to refuse and reclaim Prizes.
2.6
The detailed requirements for participating in the Giveaway
will be posted on the Promoter’s social media accounts, upon the Entry Date of
the Giveaway.
2.7
The Entrant can only participate with a single profile and/or
email account on the designated platform where the Giveaway is posted. It is
strictly forbidden to use multiple email addresses or multiple profiles to
increase the chances of winning.
2.8
Entrants may not enter or win more than one Smart Supermarket
competition within a thirty (30)-day period.
2.9
Entry must not include or refer to untruthful, incomplete,
inaccurate, or misleading information.
2.10 Entry must be made on the Entrant’s own behalf, as an
individual, and not as a representative, agent, or employee of any third party.
2.11 Entry and social media accounts must not (in the Promoter’s
discretion):
(i) violate any third-party rights,
including copyrights, trademark rights, or rights of privacy and publicity;
(ii)
contain disparaging or defamatory statements;
(iii)
include threats to any person, place, business, or group;
(iv)
(iv) be obscene, offensive, or indecent;
(v)
depict any risky behaviour;
(vi)
contain material that promotes bigotry, racism, hatred,
disrespect, or harm against any group or individual or promotes discrimination
based on race, gender, religion, nationality, disability, sexual orientation,
or age; or
(vii)
contain unauthorized third-party trademarks or logos.
2.12 The Entrant represents and warrants that its Entry:
(i)
does not violate any applicable law, rule, or regulation; and
(ii)
complies with the terms of use and any community guidelines
of the social media platform through which the Giveaway is entered (if
applicable).
3. The Prize
3.1 The Prize shall be
described within the initial Giveaway post, published on the respective social
medial platform/s. The winner shall pick up the prize from Smart Supermarket.
3.2 The winner of the Giveaway
shall be randomly selected through a draw between all the eligible entrants.
3.3 The announcement of the
winner shall be made by the Promoter through both Instagram and Facebook
platforms. The winner will be contacted through a private message on the
platform where they submitted their entry.
3.4 No changes to the Prize
are possible.
3.5 Participants who do not
win the Giveaway shall not receive any consolation or participation prize/s.
3.6 The Promoter expressly
reserves the right to change the course of the Giveaway and/or modify the
nature and scope of the Prize, as well as to replace the Prize with another one
without giving reasons, until the Prize is handed over.
3.7 The Promoter expressly
reserves the right to terminate, suspend, amend or cancel the Giveaway without
giving reasons to the Entrants. The Entrants shall be informed by the Promoter
should the case arise. This applies in particular to any reasons that would
disrupt a planned procedure of the Giveaway or would prevent it from doing so.
4. Data Protection
4.1
The Promoter hereby agrees that it shall comply with all
legislation pertaining to data protection rules, in accordance with the General
Data Protection Regulation (EU) 2016/679 and the Data Protection Act (Chapter
586 of the Laws of Malta) and any ancillary legislation thereto.
4.2
By entering the Giveaway, the Entrant consents to the
collection and processing of their personal information (including name, email
address, and telephone number) for the purposes of administering the
competition of the Giveaway and delivery of the Prize.
4.3
Winner details will be shared with the Prize provider solely
to arrange Prize fulfilment.
4.4 By accepting the prize,
the entrant agrees to participate in reasonable publicity relating to the
Giveaway, including being filmed or photographed.
4.5
Personal Data may be retained after the competition Giveaway
ends for a period of no longer than two months, but during this retention
period, will not be used for marketing purposes without the explicit consent of
the Entrant or winner, as the case may be.
4.6
The Entrant or winner can revoke their declared consent at
any time. The revocation must be submitted in writing to the Promoter at marketing@smart.com.mt. After revoking the consent,
the collected and stored Personal Data of the Entrant will be deleted
immediately.
5. Intellectual Property
5.1 By submitting an entry,
the Entrant shall exclusively grant the Promoter a royalty-free, irrevocable,
worldwide license to use their name, image, description, and any submitted
materials for promotional purposes related to the competition, without further
notice or payment.
5.2 All content published and
made available on the Promoter’s website and/or any social media platform is
the property of the Promoter itself including, but is not limited to images,
text, logos, documents, downloadable files and anything that contributes to the
composition of the Promoter’s website and/or social media platforms.
6. Liability, Waiver and
Indemnity
6.1 The Promoter is released
from all obligations upon delivery of the Prize.
6.2 The Promoter can
exclusively be held liable for damages in case of intent or gross negligence by
the Promoter itself, or where the Promoter otherwise is liable only in
accordance with applicable law. To the extent permissible under applicable
laws, the Promoter’s liability shall be limited to the value of the Prize in
the Giveaway.
6.3 The Promoter does not make
any warranties, whether express, implied or statutory, other than what is
expressly stated in these Terms and Conditions.
6.4 Access to the Giveaway
might depend on circumstances out of Promoter’s control, including actions
pertaining to third parties, such as the social media platforms and their
availability, up- or downtime, data loss, functions etc. For errors, delays,
damage, or other results based on circumstances pertained to such a third
party, the Promoter does not assume any liability.
6.5 Except where prohibited by
law, entrants agree to indemnify and hold harmless the Promoter, its parent and
affiliated companies, and all directors, officers, employees, representatives,
and agents, from any claims, demands, losses, damages, liabilities, costs, and
expenses (including legal fees) arising from or connected to their
participation in the Giveaway, their acceptance or use of any Prize, or any
breach of these Terms and Conditions.
7. Other Conditions
7.1
The decision of the Promoter is final and not subject to
appeal.
7.2
Inappropriate or offensive behaviour by the Entrant during
the Giveaway or as a result of the Giveaway will result in immediate
disqualification thereof.
8. Applicable law,
Jurisdiction and Validity
8.1 Questions or complaints in
connection with the Giveaway must be addressed to the Promoter at marketing@smart.com.mt.
8.2 The Giveaway is held under
the laws of Malta. The Promoter and all Entrants agree to the exclusive
jurisdiction of the Maltese courts. Any dispute related to the Giveaway or its
terms shall be exclusively settled by the applicable Maltese Courts or Tribunals.
8.3 If any provision of these
terms of giveaway participation is or becomes invalid as a whole or as a part,
this shall not affect the validity of these terms and conditions. Instead of
the ineffective provision, the legally permissible provision which most closely
approximates the meaning and purpose expressed in the invalid provision shall
apply.
8.4 Any portion of the
Giveaway Terms and Conditions are subject to change, cancellation or suspension
by the Promoter at any time without notice.
8.5 If at any time any of the
provisions set forth in these Terms and Conditions are found to be inconsistent
or invalid under applicable laws, those provisions will be deemed void and will
be removed from these Terms and Conditions. All other provisions will not be
affected by the removal and the rest of these Terms and Conditions will still
be considered valid.
